Mojenn Ranger Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Mojenn Ranger (the “App”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the App. These Terms are a legal agreement between you (“User,” “you”) and Mojenn LLC (“Company,” “we,” “us,” or “our”).

2. License Grant

Subject to your compliance with these Terms, Mojenn LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on an Apple iOS device that you own or control. You do not own the App. Mojenn LLC reserves all rights not expressly granted to you. You may not sell, rent, lease, distribute, or sub-license the App to any third party.

3. Description of Service & Gambling Disclaimer

Mojenn Ranger is a Texas Hold’em poker odds calculator designed to help users estimate probabilities and outcomes in poker hands. The App is provided for educational, informational, and entertainment purposes only.

No Gambling Advice: The App does not constitute gambling advice, nor does it guarantee success in real or simulated gameplay. Use of this App does not imply future success at real-money gambling.
The App must not be used in any setting where its use is prohibited by law or venue rules.
Online Platform Policies (RTA Warning): Many online poker platforms prohibit the use of software that provides real-time advice or odds calculation (often referred to as “Real-Time Assistance” or “RTA”). Using this App while playing on third-party poker platforms may violate their Terms of Service and result in account suspension, banning, or confiscation of funds. You are solely responsible for understanding and complying with the policies of any platform you use. Mojenn LLC is not liable for any penalties you incur.
Compliance with Local Laws: You acknowledge that laws regarding gambling and the use of poker assistance tools vary by jurisdiction. You are solely responsible for ensuring that your use of the App complies with all applicable laws and regulations in your specific location.

4. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18 years old, you must have permission from a parent or guardian.

5. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You may not:

Reverse engineer, decompile, or disassemble the App;
Interfere with or disrupt the operation of the App;
Use the App in any way that violates applicable laws or regulations.
Use the App to generate, display, or store content that is illegal, defamatory, pornographic, harassing, or otherwise objectionable under applicable App Store Review Guidelines.

6. User-Generated Content & Customization

The App allows you to customize the appearance of card backs using images from your device’s photo library.

Local Processing: You acknowledge that these images are processed and stored locally on your device. Mojenn LLC does not view, store, or upload your custom images to any server.
Sole Responsibility: You acknowledge that you are solely responsible for any image you select or display within the App. Mojenn LLC does not review, monitor, or control your image selection.
Intellectual Property: You represent that you have the necessary rights to use any image you select. You agree to assume full liability for any copyright or trademark infringement claims arising from your use of specific images.
Indemnification: You agree to indemnify and hold Mojenn LLC harmless from any claims, damages, or legal actions arising from the content you choose to display in the App.

7. In-App Purchases

The App is free to download and use with some feature limitations. Users may choose to unlock all features with a one-time In-App Purchase. All payments and purchases are processed through the Apple App Store and are subject to Apple’s terms and policies. Mojenn LLC does not store or have access to payment information. All refund requests must be directed to Apple; Mojenn LLC cannot process refunds directly.

8. No Personal Data Collection

Mojenn Ranger does not collect, store, or share any personal data from users.

9. Intellectual Property

All rights, title, and interest in and to the App, including its design, text, graphics, software, and trademarks, are owned by Mojenn LLC. You may not copy, modify, or distribute any part of the App without written permission.

10. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. Mojenn LLC does not guarantee that the App will be error-free or that the calculated odds will be accurate in all cases. Use of the App is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Mojenn LLC and its affiliates will not be liable for any damages, including but not limited to, loss of data, loss of profits, or any indirect or consequential damages arising from your use or inability to use the App.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mojenn LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any applicable laws, regulations, or third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the App (and the license granted herein) at any time without notice if you violate these Terms.

14. Dispute Resolution: Arbitration & Class Action Waiver

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.
Class Action Waiver: You and Mojenn LLC agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. You waive any right to have any dispute heard as a class action, a representative action, a collective action, or a private attorney general action.
Small Claims: Notwithstanding the foregoing, either you or Mojenn LLC may bring an individual action in small claims court.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law principles.

16. Severability and Non-Waiver

Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
Non-Waiver: The failure of Mojenn LLC to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Mojenn LLC.

17. Apple-Specific Terms

Because you are downloading the App from the Apple App Store, you acknowledge and agree that:

These Terms are between you and Mojenn LLC only, not Apple;
Apple has no obligation to provide any maintenance or support services for the App;
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. Apple has no other warranty obligation whatsoever;
Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a 'terrorist supporting' country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted within the App or on our website. Continued use after changes means you accept the revised Terms.
