DeckCheck Terms of Service

Effective Date: 27 March 2026

1. Acceptance of Terms

By downloading, installing, or using DeckCheck (the “App”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the App. These Terms are a legal agreement between you (“User,” “you”) and Mojenn LLC (“Company,” “we,” “us,” or “our”).

2. License Grant

Subject to your compliance with these Terms, Mojenn LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use on an Apple iOS device that you own or control. You do not own the App. Mojenn LLC reserves all rights not expressly granted to you. You may not sell, rent, lease, distribute, or sub-license the App to any third party.

3. Description of Service & Accuracy Disclaimer

DeckCheck utilizes real-time computer vision and machine learning models to identify playing cards via your device's camera and verify the completeness of a standard deck.

  • Probabilistic Nature of Machine Learning: The App's card recognition engine is based on probabilistic models. While optimized for high accuracy, we do not guarantee that the App will identify every card flawlessly 100% of the time. Factors such as lighting, card wear, highly stylized artwork, and camera quality can affect performance.
  • Not for Professional or High-Stakes Use: The App is provided for personal, informational, and utility purposes only. It should not be relied upon in professional casino environments, high-stakes tournaments, or any setting where absolute verification is legally or financially mandated. Mojenn LLC is not liable for any losses or disputes arising from misidentified or unread cards.

4. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18 years old, you must have permission from a parent or guardian.

5. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You may not:

  • Reverse engineer, decompile, or disassemble the App or its proprietary machine learning models;
  • Interfere with or disrupt the operation of the App;
  • Use the App in any way that violates applicable laws or regulations;
  • Use the App to infringe upon the intellectual property rights of third-party playing card manufacturers.

6. In-App Purchases

The App may offer premium features through In-App Purchases. All payments and purchases are processed through the Apple App Store and are subject to Apple’s terms and policies. Mojenn LLC does not store or have access to payment information. All refund requests must be directed to Apple; Mojenn LLC cannot process refunds directly.

7. Privacy and Local Processing

DeckCheck is designed to process video feeds entirely locally on your device. We do not transmit, record, or store your camera feed on any remote servers. For full details on how we handle permissions and data, please review our Privacy Policy.

8. Intellectual Property

All rights, title, and interest in and to the App, including its design, text, graphics, computer vision software, machine learning models, and trademarks, are owned by Mojenn LLC. You may not copy, modify, or distribute any part of the App without written permission.

9. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. Mojenn LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Use of the App is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Mojenn LLC and its affiliates will not be liable for any damages, including but not limited to, loss of data, loss of profits, or any indirect, incidental, or consequential damages arising from your use or inability to use the App.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mojenn LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any applicable laws, regulations, or third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the App (and the license granted herein) at any time without notice if you violate these Terms.

13. Dispute Resolution: Arbitration & Class Action Waiver

  • Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.
  • Class Action Waiver: You and Mojenn LLC agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. You waive any right to have any dispute heard as a class action, a representative action, a collective action, or a private attorney general action.
  • Small Claims: Notwithstanding the foregoing, either you or Mojenn LLC may bring an individual action in small claims court.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law principles.

15. Apple-Specific Terms

Because you are downloading the App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and Mojenn LLC only, not Apple;
  • Apple has no obligation to provide any maintenance or support services for the App;
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. Apple has no other warranty obligation whatsoever;
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
  • You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a 'terrorist supporting' country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted within the App or on our website. Continued use after changes means you accept the revised Terms.
